By now you have selected your puppy, filled out an application and patiently awaited approval. The good news is that we have verified your application and checked your references or you would not have been directed here unless you were approved. You may probably be feeling a little nervous, but very excited and a lot more anxious. Not to worry because soon your sheltie will be in your arms! Simply complete this Agreement (which we have probably already discussed at great length) via email or post and also ensure any remaining balances are settled. Once we receive the executed Agreement, we can begin to make the necessary travel arrangement from our home to yours.

This Agreement is made and entered into this [agreement.day] day of [agreement.month], [agreement.year], by and between [buyers.names] hereinafter referred to as "Buyer" and Amatras Shetland Sheepdogs, including its successors and assigns, (hereinafter referred to as "Seller").

WITNESSETH:

Whereas, in consideration for a Shetland Sheepdog, (hereinafter referred to as "Sheltie"); it is the Buyer's intention to persuade Seller to transfer ownership Sheltie from Seller's record and possession to a [ownership.limitations] [ownership.type] transfer to Buyer's record and possession (hereinafter referred to as the "Ownership Transfer") for a transfer fee of [transfer.fee] [including.excluding] expenses not to exceed [expenses.total] defined as [expenses.description] [with.without] Addendum.

Whereas, Sheltie is identified as [sheltie.color] [sheltie.sex] Shetland Sheepdog recorded by the [purebred.registry] purebred registry numbered as [sheltie.akc.no.] and named [sheltie.kennel.name] [sheltie.registered.name] [sheltie.common.name] bred by [sire.akc.no.] [sire.registered.name] [sire.common.name] out of [dam.akc.no.] [dam.registered.name] [dam.common.name] and whelped [sheltie.whelp.date]; further identified as [sheltie.microchip.no.] with unique markings noted as [sheltie.markings].

Whereas, now therefore in consideration of the premises contained herein and under the terms of payment and other good and valuable considerations, receipt of which is hereby acknowledged, Seller is willing to grant record and possession of Ownership Transfer to Buyer and the parties voluntarily enter and hereto agree, as witnessed by their signatures set forth below, and enter into accord:

1. Acknowledgement of Funds

1.1 Receipt of [transfer.fee.paid] has been [paid.promised] via [method] [reference no.] on [payment.date] and [remaining.balance] balance due to be paid in full by [date.balance.due]. In the event of default, Seller assumes all legal rights to Sheltie, monies paid to date, and shall not be further obligated to Buyer.

2. Purpose

2.1 The Buyer understands that Sheltie is a sound representative of the Shetland Sheepdog breed and is being transferred for the primary purpose as a companion animal.

2.2 This Sheltie has been selected by the Seller as a companion. Specifically, to the best of Seller's knowledge, as of this date, Sheltie is representative of the Shetland Sheepdog breed as defined in the American Shetland Sheepdog Association (ASSA) standard, recognized and adopted by the American Kennel Club (AKC).

3. Seller Assurances and Clarifications:

3.1 Sheltie has not been artificially presented nor surgically altered except Sheltie may or may not be neutered; dewclaws may or may not be removed; no genetic disorders are immediately apparent.

4. Buyer Guarantees

4.1 The Buyer agrees to provide Sheltie with complete medical, dental, grooming, and nutritional care, proper and safe housing, and love. Specifically, Sheltie will be properly licensed and inoculated against rabies and other communicable diseases and provided with heartworm preventative as recommended by a licensed veterinarian. Sheltie will not be allowed to roam and Buyer shall provide safe and humane housing, including a secure outdoor yard or run or walk on-lead with at least four hours of outside, daylight exposure; and above all else, a loving and nourishing environment for the life of the Sheltie in health and in sickness.

4.2 Buyer agrees to provide Sheltie with proper socialization and training. Seller strongly recommends that Buyer attend socialization and training classes with Sheltie and provide proper socialization opportunities for Sheltie.

4.3 Seller shall not be held responsible for acts of Sheltie due to Buyer's negligence (such as biting or attacking or bodily injury sustained to any person or being).

4.4 The Buyer agrees to provide Sheltie with proper nutritional requirements. The Buyer also acknowledges a list of recommended feeds has been provided, whereby the percent of protein does not exceed 24%.

4.5 The Buyer understands Seller has recommended a [spay.neuter] by [spay.neuter.date].

5 Seller Guarantees

5.1 Seller guarantees Sheltie to be in good health evidenced by Seller's appropriate inoculation and medical records and a certificate of good health inspection performed by a licensed veterinarian.

5.1.1 Seller requires Buyer to have Sheltie examined by a licensed veterinarian to validate 5.1 within 72 hours of Transfer. Buyer may return Sheltie for any reason during this period.

5.2 Hereditary Defects: Seller warrants against hereditary defects that result in Sheltie being unable to function as a companion animal within one year from date of whelp.

5.2.1 Verification of Hereditary Defect: The Seller requires Sheltie be examined by two veterinarians for proof of genetic or hereditary defects (one veterinarian selected by and at cost of Buyer and the second veterinarian selected by and at cost of Seller). If the veterinarians' determinations disagree, a third, unrelated veterinarian must be selected and agreed upon equally between Buyer and Seller, including the cost of the third determination split equally between Buyer and Seller, and will be the final decision. Diagnosis must be conclusive and in writing from the veterinarian(s) and must demonstrate a definitive genetic defect unrelated to injury or poor nutritional effects. Seller does not guarantee against tissue or skeletal injuries sustained during training or performance events.

5.2.2 Warranty: If a genetic defect is determined as defined in 5.2.1 above, the following options are available to Buyer during the first year: (1) The right to return Sheltie, along with executed AKC registration paperwork signed over to Seller in order to receive a full refund of the transfer fee; (2) The right to return Sheltie, along with executed AKC registration paperwork signed over to Seller in order to receive an exchange sheltie.

5.2.3 Extended Warranty: Seller warrants against hereditary defects that result in Sheltie being unable to function as a companion animal within five years from the date of this Agreement with the following option: (1) The right to return Sheltie, along with executed AKC registration paperwork signed over to Seller in order to receive an exchange sheltie.

5.2.4 Seller does not offer any other guarantee to Buyer, neither expressed nor implied outside of this Agreement.

6. Transportation

6.1 In the event of transportation costs, all shipping and associated expenses are paid by Buyer upon return of Sheltie.

7. Right of Refusal

7.1 If the Buyer decides to relinquish Sheltie to a shelter or rescue, Buyer must give Seller first right of refusal to reacquire Sheltie without fee.

8. Legal

8.1 Contact Information: Buyer agrees to keep Seller, as Seller agrees to keep Buyer informed of any changes in address, telephone number or other pertinent contact information. During the lifetime course of Buyer's ownership of Sheltie, Seller is available to answer questions regarding care, feeding and training of Sheltie at Seller's home phone number during reasonable hours or anytime at Seller's email address.

8.2 Contract Clarification: This Agreement shall be construed and governed by the laws of the State of Florida, USA and Seller has examined the State of Florida Statutes and related ordinances, and certifies this Agreement is in accordance with these laws. However, the invalidity or unenforceability of any term or provision of this Agreement shall not affect the validity of enforceability of any remaining provisions hereunder. In the event Seller incurs attorney fees and/or legal costs in securing or protecting any rights available to Seller under this Agreement, or under the laws of the State of Florida, the Buyer hereby unequivocally agrees to pay said attorneys fees and other associated costs and expenses.

8.3 Buyer Understanding and Seller Remedy: It is understood and agreed that Buyer and Seller, by duly signing this Agreement, have read and understand the conditions of this Agreement, in which Buyer's breach of this Agreement (resulting from inhumane treatment of Sheltie) shall result in physical removal of Sheltie from Buyer in which ownership is transferred to Seller, along with executed AKC registration paperwork signed over to Seller whereby full ownership rights are restored to Seller.

8.4 Modifications: This Agreement constitutes the entire understanding of all parties and may be modified only by a written Addendum signed and agreed to by all parties; herewith re-executing this Agreement evidencing the same Addendum.

"It is the consumer's right, pursuant to section 828.29, Florida Statutes, to receive a certificate of veterinary inspection with each dog or cat purchased from a pet dealer. Such certificate shall list all vaccines and de-worming medications to the animal and shall state that the animal has been examined by a Florida-licensed veterinarian who certifies that, to the best of the veterinarian's knowledge, the animal was found to have been healthy at the time of the veterinary examination. In the event that the consumer purchases the animal and finds it to have been unfit for purchase as provided in section 828.29(5), Florida Statutes, the consumer must notify the pet dealer within two business days of the veterinarian's determination that the animal was unfit. The consumer has the right to retain, return, or exchange the animal and receive reimbursement for certain related veterinary services rendered to the animal, subject to the right of the dealer to have the animal examined by another veterinarian."
